By definition, promoter region is located immediately upstream
of the transcriptional start site of a gene.
The traditional way is to first determine the transcriptional
starting site. Then subclone several kilobases region upstream
of this site into a reporter construct to test its activity in
driving transcription. To determine the critical element, you will
have to generate and test deletion mutants.
Since real promoter regions tend to be conserved among different
species, you can align upstream sequences of gene orthologues
from different species, and see if they are conserved. This will
give you an idea how upstream you should go.
